App Terms of Service

Welcome to FixerUpa (“we”, “our”, “us”).
These Terms of Service (“Terms”) govern your use of the FixerUpa app (the “App”). By accessing or using the App, you agree to these Terms. If you do not agree, please do not use FixerUpa.

1. About FixerUpa

FixerUpa is a digital tool designed to simplify renovation planning, cost tracking, and project organisation.
Our platform allows users to set budgets, allocate costs, upload receipts, and search for renovation-related products and services.

These Terms apply to the FixerUpa App only. Use of our public website is covered under a separate Website Terms of Use.

2. Eligibility

You must be at least 16 years old to use FixerUpa. By creating an account or using the App, you confirm that you meet this age requirement and that the information you provide is accurate and complete.

3. Account and Access

To use FixerUpa, you must create an account using your email address.
You will receive a verification PIN to confirm your identity each time you sign in. You are responsible for maintaining the confidentiality of your login information and for all activity on your account.

If you choose to stay signed in, ensure your device is secure and access is restricted to authorised users only.

4. Subscriptions and Payments

Access to FixerUpa requires a valid subscription, which can be purchased through our website.
We currently offer several subscription plans, including options for advanced features such as smart product and trade searches.

  • Billing: Subscriptions are billed monthly and renew automatically until cancelled.

  • Payment Processor: All payments are handled securely through Stripe via Wix.

  • Pricing: Prices are subject to change. Any updates will be communicated in advance.

  • Taxes: Prices shown may exclude VAT or other applicable taxes, which may be added depending on your location.

  • Refunds: Payments are non-refundable, except where required by law.

You can cancel your subscription at any time through your account page on the website. Access to the App will continue until the end of the paid billing period.

5. Data and User Content

By using FixerUpa, you may upload or input data including budgets, receipts, room names, renovation details, addresses, and photos.

You retain ownership of all content you upload. However, by submitting content to FixerUpa, you grant us a limited, non-exclusive licence to store, process, and display that content for the sole purpose of providing our services.

We reserve the right to remove content that is offensive, unlawful, or violates these Terms.

6. Data Storage and Deletion

You can delete your data and uninstall the App at any time from your device.
However, uninstalling the App does not automatically delete your account or stored data from our systems.

To permanently delete your account and all associated information, please contact support@fixerupa.com. Data may be retained for limited periods as required by law or for legitimate business purposes (e.g., tax compliance).

7. Features and Functionality

FixerUpa provides renovation management and tracking tools only.
We do not provide professional, legal, or financial advice, and we are not responsible for any decisions made based on information generated by the App.

The Smart Search System provides product and trade information sourced from third parties.
While we strive for accuracy, we do not guarantee that search results are complete, current, or error-free, nor do we endorse any products, services, or tradespeople displayed.

8. Service Availability

We aim to keep FixerUpa available 24/7, but we do not guarantee uninterrupted access.
Occasional downtime may occur for maintenance, updates, or technical reasons.
We are not liable for any disruption, data loss, or delay caused by such events.

9. Intellectual Property

All intellectual property in the App — including design, layout, code, and branding — is owned by FixerUpa (Hayden Kelly).
You may not copy, modify, distribute, or create derivative works without written permission.

User-uploaded content remains the property of the user but is licensed to FixerUpa for operation of the platform.

10. Limitations of Liability

FixerUpa is provided on an “as is” and “as available” basis.
We make no warranties of accuracy, completeness, or suitability for a specific purpose.

FixerUpa and its operator are not liable for:

  • Errors in budgeting, tracking, or search results.

  • Any financial losses, missed savings, or renovation outcomes.

  • The quality, pricing, or availability of third-party products or tradespeople.

  • Indirect, incidental, or consequential damages arising from use of the App.

Use of the App is entirely at your own risk.

11. Privacy and Security

Your personal data is processed in accordance with our Privacy Policy.
While we take all reasonable steps to protect your data, no system is 100% secure. You are responsible for keeping your account information safe and notifying us immediately of any unauthorised access.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, misuse the App, or engage in unlawful behaviour.
You may close your account at any time by contacting support.

13. Changes to These Terms

We may modify these Terms to reflect updates in our service or legal obligations.
Revised Terms will be posted within the App and take effect immediately upon publication. Continued use of FixerUpa means you accept the updated Terms.

14. Governing Law

These Terms are governed by Spanish law, and any disputes shall be subject to the jurisdiction of Spanish courts.
However, your local consumer rights remain unaffected.
